1. General provisions

1.1. The Senate of the Academy of Public Administration (hereinafter referred to as "the Senate") is the supreme governing body of the Academy.

1.2. The Senate operates in accordance with the Constitution of the Republic of Moldova, the Education Code, the decisions of the Government, the Statute of the Academy of Public Administration and other normative acts.


2. Constitution of the Senate

2.1. The Senate is constituted for a term of 5 years, according to the established order.

2.2. The Senate members are:

a) ex officio: Rector, who is Chairman, Deputy Rectors, chiefs of departments, chairman of the Trade union committee, chief of the Library, representatives of the Government of the Republic of Moldova, of public administration authorities;

b) elected members: representatives of faculty, master's and PhD students, ancillary services.

2.3 An electoral commission of one representative of the Rectors' office, departments, subdivisions of the Academy and the Trade union committee, elected in open assemblies of the respective departments and subdivisions. is formed for electing the Senate members specified in p. 2.2, letter "b". The Commission elects the chairman and the secretary. The Commission membership, its chairman and secretary are confirmed by the Rector's order for a period of 5 years. The minutes of electing of the commission members are maintained throughout the whole duration of the Senate activity.

2.4. The electoral commission, in agreement with the Rector, determine the total number of the Senate members and the representative share of each department, subdivision, taking into account the proportion: didactic-scientific corps - 65-75%, master's and PhD students - 20-25%, auxiliary personnel - 5-10%.

2.5. The Senate elections are held within 15 days after their announcement at: the general meetings of faculty, departments (subdivisions), support staff, PhD and master's students by open or secret vote. The conduct and results of the elections are recorded in the minutes.

2.6. To ensure compliance with the terms and procedures of the elections, the presence of at least one member of the Electoral commission at every meeting is mandatory.

The minutes of the results of  electing the Senate members are submitted, within 5 days, by the Electoral commission to the Rector in order to be kept for the period of the Senate mandate.

2.7. The Rector, within 10 days after the submission of documents by the Electoral Commission, appoints by order the Scientific secretary and other members of the Senate.

2.8. The complaints on the organization and conducting the elections of the Senate members are addressed to the Ministry of Education and the State Chancellery, within 5 days after the conclusion of elections.

2.9. In case of ascertaining the violation of this Regulation, new elections are announced.


3. Senate attributions

3.1. The Senate has the following attributions:

a) examines and approves the Academy's development strategy and sets the priority directions of its participation in elaborating the policies of public administration development and of human resource management in the public service.

b) examines the structure and the limit number of staff of the Academy and undertakes measures to optimize them;

c) approves internal normative acts;

d) approves curricula and study programs and amendments to them;

e) approves the membership of the competition commission;

f) based on requests by the chairs, makes decisions on employment through competition, in the established order, the didactic positions of university professor, associate professor, senior university lecturer, university lecturer and head of chair;

g) makes decisions on awarding the scientific-didactic titles of university / associate professor and submits the personal files examined for approval by the National Council for Accreditation and Attestation, confers the title "Doctor Honoris Causa".

h) submits, in the established order, to the National Council for Accreditation and Attestation the list of specialties for which organizes the formation of research staff through master's and doctoral studies and the list of PhD theses' advisers;

i) approves the themes and advisers of master's and PhD theses;

j) approves the conclusion of cooperation agreements with the similar institutions abroad and maintains relations with the international organizations interested in matters within the competence of the Academy;

k) approves the results of admission to study in the Academy and the graduation exams totals within master's studies;

l) approves the fees for studies, accommodation in the hostel, and for other services provided by the Academy's subdivisions;

m) approves the Academy's assets inventory results;

n) approves the report on the Academy's activity, presented annually by the Rector, and the structural subdivisions' reports;

3.2. The operative management of the Academy, between the Senate sessions, is exercised by the Senate Bureau, consisting of:the Rector, who is chairman of the Bureau, Prime Deputy Rector, Deputy Rector, directors of departments and the Scientific secretary of the Senate.

3.3 The Senate may delegate some of its attributions to the Senate Bureau or the Rector.


4. Senate and Senate Bureau sessions

4.1. The Senate operates under the Activity plan, approved at the first session of each academic year.

4.2. The Senate work form is the session. The session may be ordinary or extraordinary.

4.3. The Senate meets in ordinary session every 2 months on the third Tuesday of the month.

4.4. The Senate may be convened in extraordinary session whenever necessary.


5. Preparing the Senate session

5.1. The Senate convenes in regular sessions under the Senate Activity plan and in extraordinary sessions when necessary.

5.2 The Senate convening in ordinary sessions is announced at least five days before the session and in extraordinary session depending on the specific situation, by the Rector's disposition.

5.3. The Scientific secretary is responsible for preparing the Senate session.

5.4. The Scientific secretary:

- proposes the session agenda for approval to the Senate Chairman;

- requests from the reporters and receives the materials proposed for examination at the Senate session and the draft decisions;

- verifies the compliance of the materials presented and of the draft decisions with the requirements set;

- distributes the materials and information on the topics scheduled for examination at the session to the Senate members, at least 3 days before the session;

- prepares the Senate session room;

- checks the functioning of the technical means used at the session;

- announces and invites other persons who are to be present at the session,

- provides the maintenance of the materials examined at the session and prepares the minutes of the Senate session. 

5.5. The rapporteurs and co-rapporteurs submit the materials (report, information, the draft decision, approved by the heads of subdivisions and the jurist) for the Senate session to the Scientific secretary at least 5 days before the session.

5.6. The Senate Bureau meets in regular sessions once a month.

5.7. The Bureau may meet in extraordinary sessions whenever necessary.


6. Conducting the Senate sessions

6.1. The Senate session takes place according to the Senate Activity plan and the agenda proposed by the Scientific secretary and approved by the Senate Chairman.

6.2. Amending or supplementing the agenda are allowed only at the beginning of the session by a majority vote of the Senate members present.

6.3. The Senate session is presided by the Senate Chairman and assisted by the Scientific secretary.

6.4. The presence of Senate members at the session is mandatory. Objective situations or circumstances of force majeure make exceptions.

6.5. The Senate session is deliberative if 2/3 of the total number of members are present.

6.6. The issues on the session agenda cannot be examined unless they are accompanied by the basic report on the matter discussed.

6.7. The debates at the Senate session are recorded in the minutes.

6.8. The minutes and documents examined at the session are kept in a special folder.


7. Senate decisions

7.1. While performing its attributions, the Senate makes decisions.

7.2. Depending on the issue under examination, the Senate decisions are made by open or secret vote, by simple majority - 50% plus one vote of the total Senate membership.

7.3. Decisions on the employment by competition of the position of Rector of the Academy, head of chair, of the didactic positions of university and associate professor, and on conferring the scientific title of university and associate professor are made by secret ballot.

7.4. The Senate decisions on filling by competition of managerial and didactic positions are considered valid if the candidate was voted for no less than 50% + 1 vote of all members of the Senate.

7.5. The Decisions and the minutes of the Senate are signed within 3 days from the session date by the Senate Chairman and are countersigned by the Secretary.

7.6. The Senate decisions are communicated to the appropriate subdivisions.

7.7. The Senate decisions are mandatory for all the Academy's subdivisions.

7.8. The Senate Chairman and Secretary organize systematic control of the Senate decisions execution.


8. Final provisions

8.1. This Regulation is implemented from the date of its approval.

8.2. Amendments and supplements to this Regulation are operated by the Senate decisions at the proposal of its members.
